Writ and Difficult Services Seminar
The seminar covers bank levy and wage garnishment service requirements and procedures which represent the most common levies a process server encounters. We describe the pre-judgment and post judgment levy process, specify the minimum requirements for performing all levies, and highlight additional sheriffs’ requirements that are not in the statutes. We go through a step-by-step procedure for serving a bank levy using exemplars provided. We then describe and distinguish the service of a wage garnishment. Proofs of service for these documents must be completed and returned within 5 court days from beginning to end. We describe the proper completion of the proofs of service.
The second session covers difficult service assignments, trespass, service at prisons, and alternative service solutions, such as service by special court order. We will also discuss stakeouts, trespass, and assault and battery laws.
