On November 25, 2008 the Internal Revenue
Service issued a standard-mileage-reimbursement rate used to calculate the
deductible costs of operating an automobile for business.
The change affects the federal witness fee in 2009 by the decreasing the mileage
rate to $.55 per mile from $.58 per mile in effect from July 1, 2008 through
December 31, 2008.
The rate affects the federal witness fee calculation, adding $.55 cents per mile to the per diem (per day) fee of $40.00. That rate is calculated from the witness' residence to the place of appearance. This mileage fee is cross-referenced to 18 USC § 1821 and 5 USC § 5704, the laws governing reimbursement to governmental workers and adopted by the General Services Administration. See the article, "What is the Witness Fee for Federal Subpoenas?" that describes how the witness fee is calculated.
